BALLOT QUESTIONS

QUESTION ONE RELATING TO CONSTITUTIONAL AMENDMENT PROPOSED BY THE 2026 GENERAL COURT

1. “Are you in favor of eliminating the office of register of probate by amending articles 71 and 81 of the second part of the constitution to read as follows: [Art.] 71. [County Treasurers, County Attorneys, Sheriffs, and Registers of Deeds Elected.] The county treasurers, county attorneys, sheriffs and registers of deeds, shall be elected by the inhabitants of the several towns, in the several counties in the State, according to the method now practiced, and the laws of the state, provided nevertheless the legislature shall have authority to alter the manner of certifying the votes, and the mode of electing those officers; but not so as to deprive the people of the right they now have of electing them. [Art.] 81. [Judges Not to Act as Counsel.] No judge shall be of counsel, act as advocate, or receive any fees as advocate or counsel, in any probate business which is pending, or may be brought into any court of probate in the county of which he or she is judge.” (Passed by the N.H. House 325 Yes 15 No; Passed by the Senate 23 Yes 1 No) CACR 13

Probate Candidate Nancy Sirois, who previously held the position for about 10 years, shares her expertise:

PLEASE VOTE NO ON BALLOT QUESTION ONE, HERE’S WHY:

My name is Nancy Sirois – I served as Register of Probate for about 10 years – and fought hard to restore our constitutional right to have a person of the people serving in the Probate Court.

The Register of Probate is elected by the people. We take an oath to uphold the constitution. Out of the 3 courts; District, Family, Probate – our forefathers insisted upon having an elected representative of the people in the Probate Division as it handles wills, estates, guardianships, adoptions and involuntary commitments (Incompetency hearings) – in essence anything to do with the passing on of money or property.

  • District Division: Handles misdemeanors, small claims, landlord-tenant disputes, and minor civil matters.
  • Family Division: Handles divorce, parenting, domestic violence orders, and juvenile/child welfare cases.
  • Probate Division: Handles wills, estates, guardianships, adoptions, and involuntary commitments.

Register of Probate was supposed to be an advocate/representative for the people, a recourse from judges and corruption. The duties of the register of probate was to ensure the archives are kept properly and safe.

Because probate handles anything to do with money.

Inheritance, incompetence hearings, adoptions, property anything to do with property and handling money.

The “courts / judges” have long wanted to get rid of the register of probate. They wanted to pick their own people, not an elected person.

Sit with that for a minute.

In 2011, a bill to dismantle the register of probate was snuck into a trailer bill; which means like there were maybe a hundred bills left over and they wanted to end the session. So they put all these odd bills together and they voted “yay” or “nay”.

Because the constitution cannot be changed through the house or the senate; it must be presented to the people to vote on.

That year, without the people’s knowledge or consent – the bill passed, thus unconstitutionally giving the court the opening they’ve been looking for, they revamped the whole court system, and unceremoniously pushed out the Register of Probate.

They now call it a circuit court… and the judges appoint their own clerks, answerable only to the judges (courts).

If you value your rights as a NH Citizen, respect our Constitution, then vote NO on Question 1.

Let the people decide if they want an actual elected person to speak to verses an automated answering service…

Vote NO if you want to keep our constitutional right –

Elected Person – answerable to the people
Judge Appointed – answerable to the judge (employee)

QUESTION TWO RELATING TO THE SCHOOL DISTRICT LOCAL TAX CAP AND SCHOOL ADMINISTRATIVE FIXED CAP OF CENTRAL OFFICE – Statutory Question Required by HB 1300 CHAPTER 324, 2026.

2. “Shall [your town/ward] limit property tax growth for [your town/city’s SAU] under RSA 32:5-i? If adopted for a two-year period: (1) the local property tax levy may not grow beyond the prior year’s amount, adjusted for inflation and new construction; (2) SAU central office spending may not exceed 6 percent of total school district appropriations; and (3) bonded capital costs are excluded from both limits. These caps apply only to administrative operations of the SAU central office and do not affect classroom instruction, school-based services, or other municipal expenditures. These limits may be overridden as provided in RSA 32:5-i. Adoption requires a three-fifths (3/5) majority vote.”

Vote “Yes” if you want to try to cap your school portion of your property tax.
